Terms of Service

1. The service

First60 designs, builds and connects automated systems that reply to new inquiries, ask administrative intake questions, book appointments and log leads in a client's existing tools. We also offer an optional monthly support plan (“Care”).

First60 is not a law firm and does not provide legal advice. Our systems handle administrative intake only. No attorney-client relationship exists between First60 and anyone, and no attorney-client relationship is created between a client firm and any person through our systems; that decision is made only by the client firm.

2. Engagements

Each engagement is described in a written proposal or order that the client accepts. If a proposal conflicts with these terms, the proposal controls for that engagement.

3. Fees and payment

• Setup fees are one-time. Unless the proposal says otherwise, 50% is due before work begins and 50% at launch.
• Care plans are billed monthly in advance and are month to month. Either party may cancel with notice before the next billing date.
• Usage costs (such as texting, phone numbers and AI usage) are paid by the client, either directly to the provider or billed at cost.
• Late invoices may pause work or support until paid.

4. Client responsibilities

The client is responsible for:

• Reviewing and approving all scripts and messages before launch
• Complying with its professional conduct rules, attorney advertising rules, and laws on consent, text messaging, call recording and privacy that apply to it
• Supervising the system and reviewing every lead; all decisions about representation remain with the client
• Providing accurate information and the access we need, and keeping its own accounts with third-party tools in good standing

5. Third-party services

Our systems connect to third-party tools such as phone, messaging, AI, calendar and practice management providers. Their use is subject to those providers' terms, and we are not responsible for their outages, changes or pricing.

6. Data and confidentiality

• The client owns its data, including information from its prospective clients.
• We access client data only to build, operate and support the service, and we keep it confidential.
• We configure AI services so that client data is not used to train AI models.
• When an engagement ends, we remove our access and delete any copies we hold, unless the law requires otherwise.

7. Results

We design every system to reply within 60 seconds under normal operation and include fallbacks so inquiries reach the client if a step fails. We do not guarantee specific response times in every case, numbers of consultations, or business results.

8. Intellectual property

The client owns its data, accounts and content. First60 keeps ownership of its methods, templates and know-how, and grants the client the right to use the workflows we build in its own accounts for as long as it uses them.

9. Disclaimers

Except as stated in a signed proposal, the services are provided “as is,” without warranties of any kind, to the extent the law allows.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, including lost profits or lost business. First60's total liability for any claim is limited to the fees the client paid First60 in the 12 months before the claim.

11. Termination

Either party may end an engagement with written notice. Fees for work already completed remain payable. Sections on data, intellectual property, disclaimers and liability survive termination.

12. Governing law

These terms are governed by the laws of the State of Illinois. Any dispute will be handled in the state or federal courts located in Cook County, Illinois.

13. Changes

We may update these terms. The date at the top shows the latest version, and we will notify active clients of material changes by email.
